Terms and Conditions for Participation in the LinkedIn Giveaway
1. Scope
These terms and conditions apply to all giveaways organised by Salomon FoodWorld GmbH, Nordring 13, 63762 Großostheim-Ringheim, Germany, hereinafter referred to as the “Organiser”. By participating in the giveaway, each participant accepts these terms and conditions.
This giveaway is not affiliated with LinkedIn. It is in no way sponsored, endorsed, administered by or associated with LinkedIn. No legal claims against LinkedIn arise from participation in this giveaway. All information relating to this giveaway is provided solely by the Organiser.
2. Participation
2.1 Participation is open to natural persons acting in their own name who are at least 18 years old. Participants who have reached the age of 16 but are not yet of legal age may only participate with the consent of their legal guardians.
2.2 Minors under the age of 16 and persons without legal capacity are excluded from participation.
2.3 The Organiser reserves the right to exclude participants who violate these terms and conditions or who attempt to gain an advantage over other participants through improper influence or manipulation of the giveaway. In such cases, the Organiser may also exclude participants retroactively, revoke prizes and reclaim them.
2.4 Participation is only possible within the period stated in the giveaway description. Each participant may only participate once in the same giveaway.
2.5 Employees of the Organiser, employees of companies involved in this giveaway and their immediate family members are excluded from participation.
3. Execution of the Giveaway
3.1 To participate in the giveaway, participants must follow the Organiser’s LinkedIn page, like the giveaway post and comment on the post as described in the giveaway announcement. If any additional participation requirements apply, these will be stated directly in the giveaway post.
The giveaway will take place during the period specified in the giveaway announcement. All participants who meet the requirements set out in sections 2 and 3 by the time of the draw will be included. Immediately after the participation period has ended, the winner will be selected at random from all eligible participants.
3.2 The prize cannot be changed, exchanged for cash or transferred to another person.
4. Prize Fulfilment
4.1 The winner will be notified by email, LinkedIn direct message or another electronic means by the Organiser. Each notified winner must inform the Organiser within one month of receiving the notification whether they accept the prize. If the Organiser does not receive a response within this period, the opportunity to accept the prize will expire and the Organiser reserves the right to select and notify another participant.
4.2 If the contact details provided by the participant are incorrect, for example an incorrect email address, the Organiser is not obliged to determine the correct details. Any disadvantages arising from incorrect contact details shall be borne by the participant.
4.3 If a physical prize cannot be properly delivered by the shipping service provider, the Organiser will make reasonable efforts to involve the shipping service provider in resolving the matter. In such a case, there is no entitlement to receive the prize.
5. Liability for Defects
The Organiser is only liable for damages incurred by the winner due to material and/or legal defects in cases of fraudulent intent, intent or gross negligence. Any further liability for material and/or legal defects is excluded.
6. Early Termination, Adjustment or Modification of the Giveaway
The Organiser is entitled to terminate, adjust or modify the giveaway at any time without prior notice and without stating reasons if proper execution of the giveaway cannot be guaranteed for technical or legal reasons.
7. Applicable Law
All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany. For consumers, this choice of law shall only apply insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

The above-mentioned controller is responsible for the data processing carried out in connection with the giveaway on the LinkedIn page. To the extent that data is processed by LinkedIn in connection with the use of the platform, LinkedIn Ireland Unlimited Company, Ireland, may also be responsible as the platform operator.
8.1 Processing of Personal Data in Connection with the Giveaway
We process your personal data for the proper execution and fulfilment of the giveaway, in particular for contacting the winner and sending the prize.
For the purpose of conducting the giveaway, the LinkedIn profile name and, where available, the first and last name of the respective participant will be collected and stored. For the purpose of sending the prize, we will additionally collect the winner’s first name, last name and address and pass this data on to a shipping service provider commissioned by us. No further transfer of your data to third parties will take place.
The legal basis for processing your personal data is Art. 6(1)(b) GDPR, namely the performance of pre-contractual measures and fulfilment of a contract.
If we publish the winner’s first and last name separately on our profile, company page or externally, for example in our online shop, this will only take place with the winner’s prior express consent pursuant to Art. 6(1)(a) GDPR.
8.2 Storage Period
After the giveaway has ended, your personal data processed in connection with the giveaway will be deleted no later than three months after the end of the giveaway, unless valid consent for further processing exists, for example for newsletter purposes, and/or we have a legitimate interest in continued storage.
8.3 Your Rights as a Data Subject
Under applicable data protection law, you have the following rights:
Right of access pursuant to Art. 15 GDPR:
You have the right to obtain information about your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria used to determine that period, the existence of a right to rectification, erasure, restriction of processing or objection to processing, the right to lodge a complaint with a supervisory authority, the origin of your data if it was not collected from you, the existence of automated decision-making including profiling and, where applicable, meaningful information about the logic involved as well as the significance and intended consequences of such processing. You also have the right to be informed about appropriate safeguards pursuant to Art. 46 GDPR in the event of data transfer to third countries.
Right to rectification pursuant to Art. 16 GDPR:
You have the right to obtain without undue delay the rectification of inaccurate personal data concerning you and/or the completion of incomplete personal data stored by us.
Right to erasure pursuant to Art. 17 GDPR:
You have the right to request the erasure of your personal data if the requirements of Art. 17(1) GDPR are met. This right does not apply in particular where processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.
Right to restriction of processing pursuant to Art. 18 GDPR:
You have the right to request the restriction of processing of your personal data while the accuracy of your data is being verified, if you oppose the erasure of your data due to unlawful processing and instead request restriction of processing, if you need the data for the establishment, exercise or defence of legal claims after we no longer need it, or if you have objected to processing pending verification of whether our legitimate grounds override yours.
Right to notification pursuant to Art. 19 GDPR:
If you have exercised your right to rectification, erasure or restriction of processing, the controller is obliged to inform all recipients to whom the personal data has been disclosed of this rectification, erasure or restriction of processing, unless this proves impossible or involves disproportionate effort. You have the right to be informed about these recipients.
Right to data portability pursuant to Art. 20 GDPR:
You have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format or to request its transmission to another controller, where technically feasible.
Right to withdraw consent pursuant to Art. 7(3) GDPR:
You have the right to withdraw consent once given at any time with effect for the future. In the event of withdrawal, we will delete the data concerned without undue delay unless further processing can be based on another legal basis. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
Right to lodge a complaint pursuant to Art. 77 GDPR:
If you believe that the processing of your personal data violates the GDPR, you have the right to lodge a complaint with a supervisory authority, without prejudice to any other administrative or judicial remedy.
